Policy Summary
This law governs water rights, access, usage, and irrigation. It allows “state waters,” also known as surface waters, to be diverted for agricultural purposes. Moreover, agricultural uses rank second in priority for appropriation of state waters after domestic and household use. This benefits urban farms and gardens, because it recognizes that water use to produce food is a priority to the state.
