Exempting farms from private nuisance suits
La. Rev. Stats., art. 3, § 3603 (1983).
Last Visited 3/31/26
Policy Summary
This law establishes the state’s “right to farm law” by forestalling nuisance law suits against agricultural operations so long as (1) the operation was in place before the objecting neighbor moved in or (2) the operation has been substantially unchanged for at least one year prior to the time of the lawsuit. This could be beneficial to urban farms and gardens who are protected from nuisance litigation or create challenges for these operations and urban community members whose property is being polluted by a neighboring farm.
