Protecting longstanding agricultural operations from local interference
3 P.S. § 951-957 (2025).
Last Visited 3/31/26
Policy Summary
This law prohibits generally accepted agricultural activities from restriction by local ordinance or private nuisance claims when they remain substantially unchanged. These restrictions do not apply to flooding or water flow that constitutes trespass. This could be beneficial to urban farms and gardens who are protected from nuisance litigation or create challenges for farmers or community members whose property is being polluted by a neighboring farm.
